Terms of Service

1. Acceptance of Terms

By accessing or using Dynasty Dash ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age (or older if required by your local law) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Description of Service

Dynasty Dash is a dynasty fantasy football management dashboard that aggregates and displays data from third-party fantasy football platforms, including but not limited to Sleeper and My Fantasy League (MFL). The Service provides features such as roster visualization, draft board management, depth charts, trade analysis tools, and league information display.

The Service is currently provided free of charge. We may offer paid features or subscription tiers in the future; if we do, additional terms will apply and we will present them at the time of purchase.

4. Account Registration and Security

To use certain features of the Service, you may need to create an account or authenticate through a third-party platform. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

5. User Conduct and Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems, bots, or scrapers to access the Service without permission
• Attempt to bypass any rate limiting or API access controls
• Reverse engineer, decompile, or disassemble any part of the Service
• Share authentication tokens, API keys, or account credentials with others
• Impersonate any person or entity or misrepresent your affiliation
• Circumvent any access controls or usage limits

6. Data Collection and Privacy

We collect and process the following types of data:

• Account identifiers: Your username or league ID/team name used to connect to fantasy platforms
• Fantasy league data: Roster information, draft picks, league settings, and other data synced from connected fantasy platforms
• User preferences: Your settings, customizations, and configurations within the Service
• Usage analytics: Pseudonymous data about how you interact with the Service, collected via PostHog, to help us improve the user experience
• Cookies and local storage: We use cookies and local storage for authentication, session management, and analytics

We do not sell your personal information as that term is defined under applicable law. Data is shared only with service providers necessary to operate the Service (such as hosting and analytics providers) and is used solely to provide and improve the Service.

You may request deletion of your account and associated data by contacting us at the email below. We will take reasonable steps to honor deletion requests within a reasonable time, though we may retain certain logs for security, legal compliance, or fraud prevention purposes.

Our Privacy Policy, available separately, is incorporated by reference into these Terms.

7. Third-Party Services and Non-Affiliation

The Service integrates with third-party platforms including Sleeper, My Fantasy League, and PostHog. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.

Data retrieved from third-party platforms is provided "as is" and we make no guarantees about its accuracy, completeness, or timeliness. Third-party platform availability and API access may change without notice.

Non-Affiliation: Dynasty Dash is not affiliated with, endorsed by, or sponsored by Sleeper, My Fantasy League, the National Football League (NFL), or any NFL team. All third-party trademarks, service marks, and trade names referenced in the Service are the property of their respective owners and are used for identification purposes only.

8. Intellectual Property

The Service, including its design, features, and content (excluding user content and third-party data), is owned by Dynasty Dash and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without express written permission.

Player names, team names, and league data displayed in the Service are the property of their respective owners and are used for informational purposes only.

9. User Content

You may be able to submit, post, or store text content through the Service, including notes about leagues, players, and plans ("User Content"). You retain ownership of your User Content.

You grant Dynasty Dash a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers), and transferable license to host, store, reproduce, modify (for formatting and technical processing), display, and distribute your User Content solely as necessary to operate, maintain, and improve the Service.

You represent and warrant that: (a) you own or have all rights needed to provide your User Content, (b) your User Content does not infringe or violate any third-party rights (including intellectual property, privacy, or publicity rights), and (c) your User Content complies with these Terms and applicable law.

You agree not to submit User Content that is unlawful, defamatory, harassing, hateful, pornographic, exploitative, or that includes others' personal information without permission, or that contains malware, spam, or deceptive links.

We may (but are not required to) monitor, remove, or restrict access to User Content at any time for any reason, including to enforce these Terms or reduce risk. We have no responsibility for User Content posted by you or others.

10. Copyright Complaints

If you believe content on the Service infringes your copyright, please contact us at info@dynastydash.com with:

• Identification of the copyrighted work
• Identification of the allegedly infringing material and where it appears
• Your contact information
• A statement that you have a good-faith belief the use is unauthorized
• A statement under penalty of perjury that the information is accurate and you are the owner or authorized to act on the owner's behalf

We may remove content in response to valid complaints and may terminate the accounts of repeat infringers.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Fantasy Data Accuracy: Fantasy football data displayed in the Service is sourced from third-party platforms and may contain errors, inaccuracies, or outdated information. We do not guarantee the accuracy, completeness, or reliability of any player statistics, rankings, projections, or other fantasy-related data. You acknowledge that fantasy football involves inherent uncertainty and that decisions made using this Service are made at your own risk.

No Professional Advice: The Service does not provide professional, financial, or gambling advice. Any analysis, rankings, or recommendations are for informational and entertainment purposes only.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYNASTY DASH AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any errors, inaccuracies, or omissions in the data displayed
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service
• Decisions made based on information provided by the Service

Liability Cap: To the maximum extent permitted by law, Dynasty Dash's total liability for any claim arising out of or relating to the Service will not exceed the greater of $100 or the amount you paid Dynasty Dash in the 12 months before the claim arose.

12. Indemnification

You agree to defend, indemnify, and hold harmless Dynasty Dash and its members, managers, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service, (b) your User Content, (c) your violation of these Terms or applicable law, or (d) your violation of any rights of any third party, including intellectual property, privacy, or publicity rights.

13. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by contacting us.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado and applicable federal law, excluding conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenient forum.

16. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
• Entire Agreement: These Terms, together with any incorporated policies, constitute the entire agreement between you and Dynasty Dash regarding the Service.
• Force Majeure: We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.
• Survival: Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and any other provisions that by their nature should survive, will survive termination of these Terms.
